Acceptable use policy

Why this exists

This acceptable use policy (AUP) sits alongside our Terms of use for the public website. For messaging, voice, or related communications services Jungle Drum Limited provides (the “Services”), it binds senders because their customer contract incorporates it. It does not, by itself, replace or terminate that contract.

If you violate this AUP we may refuse a waitlist signup, suspend sending, or block traffic. Where your customer contract incorporates this AUP, we may also take the steps that contract allows. Charges already incurred remain payable as that contract says. We may report illegal activity to authorities or carriers. The list below is not exhaustive.

Website

  • Do not attack, probe, or overload the site.
  • Do not submit other people’s email addresses to the waitlist without their permission.
  • Do not use the site to distribute malware or to phish.

Emergency services

The Services are not a substitute for emergency services. You must not use them to contact 111 or an equivalent emergency answering point, or as the sole channel for life-critical alerting. We do not connect to emergency answering points.

Consent and identity (messaging)

Before you send marketing or other commercial messages through the Services, you must have the consent the law and the destination network require. In New Zealand that includes the Unsolicited Electronic Messages Act 2007 for commercial electronic messages. The same consent and opt-out rules apply to SMS, RCS, and other commercial messages you send through us. Consent must be informed, specific to you as sender, and easy to withdraw. Bought, scraped, or “shared” lists are not consent.

Identify yourself (or the brand the recipient agreed to hear from) in the message. Honour STOP, unsubscribe, HELP (or the local equivalent), and any other keyword a carrier requires. HELP replies must name the brand and how to opt out. Do not charge a fee to opt out. Do not send to numbers after opt-out, except a single confirmation where that is allowed.

Numbers and registration

Allocated numbers and sender IDs are licensed, not sold. We or the network may reclaim, migrate, or refuse assignment. You must complete any destination brand, sender, or campaign registration the network requires, and keep it accurate, before you send.

Delivery

Networks may delay, filter, or fail messages. Following this AUP is not a delivery warranty or an SLA.

Prohibited content and campaigns

You must not use the Services (and you must not allow your users to use them) to send or host:

  • Spam, snowshoeing, or any campaign designed to evade filters or volume caps, including obfuscated links or public URL shorteners used to evade filters.
  • Phishing, smishing, vishing, social engineering, or credential theft.
  • Fraud, impersonation of a person, brand, bank, government, or carrier.
  • Malware, ransomware, or links to exploit kits.
  • Harassment, threats, or content that promotes violence or terrorism.
  • Child sexual exploitation or any sexual content involving minors — we will report this.
  • Unlawful pornography or content that is illegal in the sender’s or recipient’s country.
  • Hate speech or discrimination — we may refuse this even where it is not unlawful.
  • Content that infringes copyright, trade marks, or other IP, other than fair dealing or licensed use.
  • Traffic to destinations we or applicable sanctions rules prohibit.

Restricted use cases

Some verticals are legal in places and banned or filtered by carriers in others (for example cannabis, alcohol, gambling, firearms, adult content, cryptocurrency, third-party debt collection, or high-cost lending). You must not send those campaigns unless it is lawful at both ends, the destination network allows it, and you have completed any extra registration or vetting we or the carrier require. Age-gated campaigns must be age-gated for the recipient, not only lawful. We may refuse those use cases even where legal.

Network and platform abuse

  • No flooding, artificially inflated traffic, or SIM-farm style origination.
  • No spoofing of alphanumeric sender IDs you are not authorised to use.
  • No attempts to bypass our, a carrier’s, or a regulator’s safeguards, including number shuffling to hide opt-outs.
  • No using trial or demo credits for production spam.
  • You must keep credentials secret. If they leak, use the channel in your customer contract.

Accounts

Messaging accounts are for people aged 18 or over, or for a company. Trial or demo senders are still bound by this AUP and by whatever customer or trial terms we issue with that access.

Your responsibility

You are responsible for your end users and for the legality of your content and consent records. If you resell or allow others to send, you remain responsible for their traffic. You must keep proof of consent for as long as the law or carrier codes require. We may request those records if a complaint, regulator, or carrier asks. We are not obliged to carry traffic that would put our numbers, brands, or other customers at risk.

Enforcement

We may monitor traffic metadata and, where we reasonably suspect abuse, inspect message content. That is not a substitute for your compliance. We may remove content or suspend sending without prior notice where we reasonably believe this AUP, a law, or a carrier code is being broken.
